In Arizona, home owner's associations cannot prevent a home owner from installing a solar system on their home. At Solar Path, we believe that your relationship with your neighbors and HOA are very important and we work hard designing your system to be as integrated into the design of your home as possible so that HOA approvals are a breeze. Some homeowners associations have tried to restrict people from installing solar panels for a variety of reasons. Arizona law now protects individual homeowners’ private property rights to solar access by dissolving any local covenant, restriction or condition attached to a property deed that restricts the use of solar energy.
Here is the exact article from the Arizona State Legislature:
A. Notwithstanding any provision in the community documents, an association shall not prohibit the installation or use of a solar energy device as defined in section 44-1761.
B. An association may adopt reasonable rules regarding the placement of a solar energy device if those rules do not prevent the installation, impair the functioning of the device or restrict its use or adversely affect the cost or efficiency of the device.
C. Notwithstanding any provision of the community documents, the court shall award reasonable attorney fees and costs to any party who substantially prevails in an action against the board of directors of the association for a violation of this section.
